Terms of Service
Welcome to Clearhavn. These Terms of Service ("Terms") are an agreement between you and Clearhavn governing your access to and use of our website and application (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
What Clearhavn is — and is not
Clearhavn is a tool that helps you organize incidents, evidence, deadlines, and timelines into a clear, private record. It is designed for people preparing for or navigating high-stakes life situations, including family law matters.
Clearhavn is not a law firm and does not provide legal advice. Nothing in the Service is a substitute for advice from a licensed attorney in your jurisdiction. We do not represent you, do not form an attorney-client relationship with you, and cannot tell you whether you have a case, what to argue, or what to do in court. If you are considering legal action, talk to a licensed attorney.
Eligibility and accounts
- You must be at least 18 years old to create an account.
- You are responsible for keeping your password (and PIN, if you set one) confidential. Do not share your account.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate information when you sign up and to keep it up to date.
- If you suspect unauthorized use of your account, change your password immediately and contact us.
Your content
You retain all rights to the case content you create or upload to Clearhavn — events, journal entries, attachments, documents, and any other information you store in your account ("Your Content").
You grant us a limited, non-exclusive license to host, store, copy, back up, transmit, and display Your Content solely for the purpose of operating the Service for you. We do not use Your Content to train AI models, to advertise to you, or to share with third parties beyond the service providers listed in our Privacy Policy.
You are responsible for ensuring you have the right to upload Your Content and that doing so does not violate the law or anyone else's rights.
Acceptable use
You agree not to use Clearhavn to:
- Violate any law or the rights of any person
- Upload content you do not have the right to share
- Upload malware, viruses, or any code intended to disrupt the Service
- Attempt to gain unauthorized access to other accounts or to our systems
- Reverse engineer, scrape, or copy the Service for competitive purposes
- Resell, sublicense, or commercially exploit the Service without our written permission
- Use the Service to harass, threaten, or impersonate any person
We may suspend or terminate accounts that violate these rules, generally with notice when reasonable.
Plans and payment
Clearhavn offers a Free plan and a paid Pro plan. Plan limits and features are described on the pricing page.
- Free plan — available at no cost, subject to plan limits.
- Pro plan — billed monthly at the price shown on the pricing page. Subscriptions renew automatically until canceled. You can cancel any time from your account settings; cancellation takes effect at the end of your current billing period.
- Payment processing — handled by Stripe. We do not see or store your full card number.
- Refunds — we do not generally offer refunds for partial billing periods, but contact us if you believe you were charged in error and we will look into it in good faith.
- Price changes — we may change subscription prices with at least 30 days' notice by email. Changes apply at your next renewal.
Sharing with attorneys or other people
Pro accounts may invite others (such as an attorney) to view a case as a read-only collaborator. The invited person can see everything in the shared case but cannot edit, delete, or export records. You are responsible for who you invite and for revoking access when it is no longer needed.
Privacy
Your use of Clearhavn is also governed by our Privacy Policy, which explains what data we collect, how we store it, and your rights over it.
Account termination
You may delete your account at any time from inside the app or by emailing us.
We may suspend or terminate your account if you violate these Terms, if your use creates risk or possible legal exposure for us, or if you fail to pay for a paid plan. Where reasonable, we will give you notice and a chance to cure the issue.
On termination, your right to use the Service ends. We will delete Your Content within 30 days, except where we are required to retain limited information for legal or accounting reasons.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or secure.
Clearhavn does not guarantee any particular outcome in your legal, family, or personal matters. The Service is a tool to help you stay organized — your decisions, and the outcomes of any legal proceeding, are your own responsibility (and the responsibility of your attorney, if you have one).
Limitation of liability
To the maximum extent permitted by law, Clearhavn and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.
Our total liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Clearhavn and its contributors from any claim, demand, damages, or expenses (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service, or (c) your violation of these Terms or any applicable law.
Changes to the Service or these Terms
We may modify the Service at any time, including adding, removing, or changing features. We may also update these Terms from time to time. For material changes, we will notify you by email or in the app before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of [STATE], United States, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in [COUNTY, STATE], and you consent to the personal jurisdiction of those courts.
